Therefore the sale of products marketed by the www.chocolate7.com website is subject to the terms and conditions indicated below.

Please read them carefully before using the site.

By using this site you accept the following terms and conditions.

3 – OUR COMMERCIAL POLICY

The Seller offers for sale on www.chocolate7.com the products and carries out its e-commerce activity exclusively towards its “consumer” end users.

The consumer is any natural person who buys one or more products through the www.chocolate7.com website, for purposes not related to his business, by accepting the General Conditions.

In consideration of its commercial policy, the Seller reserves the right not to process orders from parties other than the “consumer” and which are not duly completed in accordance with the provisions of the General Conditions of Sale.

These General Conditions of Sale exclusively regulate the offer, sending and acceptance of orders between users of www.chocolate7.com and the Seller

4 – HOW TO BUY

You can browse within our site by choosing the section from the navigation menu. You can more easily find the product you want using search filters. To view the details of the article, click on the corresponding photo. You will then enter the Product Sheet, where you can find all the information necessary to proceed with the purchase. If the ordered products are temporarily unavailable, you will be promptly informed and asked to leave us your email address in order to inform you of the unavailable product at the time of your order.

The Product Sheet is the area where you can find the features and details of a product and can be reached by selecting an item. Here you will find information on the product and the price.

From the Product Tab you can save the item in the Wish List or you can add it to the cart to buy it.

To purchase a product you must add it to the cart. To add an item to the Shopping Cart, in the Product Tab you can click on Add to Cart. The product will be placed in the Shopping Cart and you can view it at any time by moving your mouse to Cart. You can decide whether to continue shopping by adding other products to the Shopping Cart, or end the purchase immediately.

When you access the first page of the Checkout you can select the shipping and payment methods and change the quantities of the products ordered. The total amount of the order that will appear on the first page of the Checkout corresponds to the total final amount of the order.

Confirm the data to proceed with the order. To complete it, you will need to add the destination address. If you are already registered you can enter the access codes and recall the previously saved addresses. By clicking Continue you will be directed to the Data Confirmation page where you will need to verify that the data entered and the products purchased are correct. By clicking on Complete the order you will be directed to the Payment page.

Your purchase is concluded when the thank you page appears and you are assigned a order number.

You will receive a confirmation email within a few minutes.

5 – HOW TO CONCLUDE THE CONTRACT WITH THE SELLER

To conclude the purchase contract for one or more products on www.chocolate7.com, you must complete the order form in electronic format and send it to the Seller, electronically, following the relative instructions.

The order form contains a summary of information on the essential characteristics of each product ordered and the relative price (including all applicable taxes or duties), the payment methods that you can use to purchase each product and the delivery methods of the purchased products, shipping and delivery costs, conditions for exercising the right of withdrawal and the methods and times for returning the goods purchased.

The contract is concluded upon receipt by the Seller, electronically, of the order form, after verifying the correctness of the data relating to the order itself.

Before proceeding with the purchase of the products, you will be asked to carefully read and accept the General Conditions of Sale.

The order form will be filed in our database for the period of time necessary to process the orders and in any case in accordance with the law. You can view your order form by logging in with your credentials in the Reserved Area.

The Seller may not process purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or if the products are not available. In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not followed up your purchase order specifying the reasons. If the products presented on www.chocolate7.com are no longer available or for sale at the time of your last access to the site, or the sending of the order form, it will be the Seller’s responsibility to inform you within thirty (30) days of from the day following the day on which you have sent your order to the Seller, any unavailability of the ordered products. In the event that the order form is submitted and the price has been paid, the Seller will reimburse the amount already paid by you.

With the electronic transmission of the order form, you unconditionally accept and undertake to observe, in relations with the Seller, the above General Conditions of Sale. If you do not agree with any of the terms set out in the General Terms of Sale, please do not submit the order form for the purchase of products on www.chocolate7.com.

By submitting the order form, you confirm that you know and accept the General Terms and Conditions of Sale and the additional information contained on www.chocolate7.com, also referred to through links, including the Privacy Policy and the Information on the Right of Withdrawal.

Once the contract is concluded, the Seller will send you, by e-mail, a receipt of the purchase order, containing a summary of the information already contained in the order form.

6 – ACCEPTANCE OF SALES CONDITIONS

The contract stipulated between Choc7 of Benedetto Giovanni and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Choc7 di Benedetto Giovanni, which reserves the right, at its sole discretion, to accept the order . Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general payment conditions transcribed below.

7 – PRODUCT SHEET AND PHOTO

The essential characteristics of the products are presented on www.chocolate7.com within each product page. Our commitment is maximum in the accurate presentation of the product through photos, texts, illustrations and videos. However, the images and colors of the products offered for sale on www.chocolate7.com may not correspond to the real ones due to the Internet Browser, devices and monitor used. In fact, we would like to point out that the color rendering of photos and videos strongly depends on the calibration of the Internet Browser, the devices and the monitor used. Choc7 di Benedetto Giovanni cannot be held responsible for a failed calibration of the devices and monitor used and cannot guarantee that your devices and monitors display the colors and textures exactly as they are actually in the product.

The sensory evaluation sheet and the technical sheet in the product sheet are prepared by Giovanni Benedetto. Choc7 di Benedetto Giovanni, therefore, reserves the right to modify the technical information of the products to adapt them to those provided by the manufacturers, without prior notice

8 – PRICE OF PRODUCTS

The prices shown include VAT, packaging and packaging.

We always try to offer you the best price on the market but we cannot guarantee that it will always be the lowest.

Choc7 di Benedetto Giovanni reserves the right to change prices at any time, without notice.

Make sure of the final sale price before submitting the relevant order form.

In the event that an incorrect and / or clearly insignificant price is published, for any reason (error in our systems, human error, etc.), the order will be canceled, even in the event of initial validation.

Purchase requests from countries that are not among those on the Country Selection page cannot be accepted by the Seller.

In the product sheet “Packages on offer” can be proposed for the purchase of more pieces or discounts depending on the quantity purchased.

The site will automatically calculate the net discount based on the quantity of products in the cart.

Some of the submitted articles may be for a limited period of time further discounted. In this case the “Promo” label is shown and the price is highlighted in the product sheet.

If the price of the product is reduced after the purchase at full price we cannot repay the difference.

9 – AVAILABILITY OF PRODUCTS

In the product sheet you will have the possibility to check the stock in that moment. We try to do our best so that the quantity of product indicated on the site is correct but it can happen that there are errors in the warehouse stock or that more orders confirmed at the same time lead to a lack of availability.

The indication of the quantity available is purely indicative and not binding. For this reason, we reserve the right, once the order is received, to check the availability of the goods and, failing that, to promptly communicate the non-acceptance of the order sent. No responsibility can be attributed to Choc7 of Benedetto Giovanni.

If the product is not immediately available you will not be able to proceed with the purchase and the message “Not available” will be shown.

10 – TRANSMISSION OF ORDERS

You have the opportunity to purchase any available product published on our site. After selecting the product (s) and placing them in the cart, you will be able to verify before completing the order all the accessory costs related to delivery and payment according to your preferences.

Once the check-out procedure has started, you can indicate the delivery address of the order and, if different, the one for the header of the receipt.

If you need to receive the sales invoice in place of the receipt, you must notify the order conclusion phase by indicating the tax code and / or VAT number. No change will be possible after the order has been shipped.

All sales documents (order, receipt, delivery note and invoice) will be sent to you exclusively via e-mail pursuant to art. 14 Presidential Decree 445/00 and Decree 52/2004. No documents can be sent by regular mail.

Correct receipt of the order is confirmed by sending an e-mail to the address you have communicated. In the event of non-acceptance of the order Choc7 di Benedetto Giovanni undertakes to communicate it promptly.

This confirmation message will re-present all the personal data you entered and the list of purchased items. Any inaccuracies, changes to the address or notes to the courier must be communicated at this stage.

Changes to the delivery or billing address are only possible before the order is prepared by sending an eMail to customer support: ordini@chocolate7.com.

Once the order has been delivered to the courier, it will no longer be possible to change the destination address until at least the first delivery attempt occurs.

The sending of the order automatically implies acceptance of the General Conditions of Sale present here.

The order can be canceled up to the time of preparation, obtaining a full refund of the amount paid by sending an e-mail to ordini@chocolate7.com. If the order has already been prepared or delivered to the courier it will not be possible to cancel it. You can of course return the unwanted products following the withdrawal procedure.

11 – CANCELLATION OF AN ORDER

The order can be canceled up to the time of preparation, obtaining a full refund of the amount paid by sending an email to ordini@chocolate7.com.

If the order has already been prepared or delivered to the courier it will not be possible to cancel it. You can of course return the unwanted products following the withdrawal procedure.

12 – CANCELLATION OF PURCHASE

You have the right to reject the goods upon delivery. It should be noted, however, that upon the issuance of the repayment credit note, in the case of prepayment (Paypal, credit card, bank transfer in advance), the costs of returning the items to our warehouse equal to the shipping costs will be reversed (€ 8.85 for Italy, San Marino and Vatican City and € 14.85 for the European Union). The right of withdrawal is reserved exclusively to private customers, retailers are excluded, to whom the actual transport costs incurred for sending and returning the goods will be charged.

13 – DISPUTE RESOLUTION

If you have submitted a complaint that we could not resolve together, please note that the online consumer dispute resolution service was established by law. From 9 January 2016 there is an online platform where you can find the list of organizations you can turn to to open an online dispute resolution procedure. Therefore Choc7 di Benedetto Giovanni informs the user that he is a consumer pursuant to art. 3, paragraph 1, lett. A) of the Consumer Code, which established a European platform for the online resolution of consumer disputes (c.d. ODR platform).

through the ODR platform the consumer user will be able to consult the list of ADR entities, find the link to the site of each of them and start an online resolution procedure of the controversial in which it is involved.

In any case, whatever the outcome of the procedure for out-of-court settlement of the dispute, your rights to contact the ordinary judge and, if the conditions are met, to promote an out-of-court resolution of disputes relating to consumption relationships are subject to appeal. to the procedures referred to in Part V, Title II-bis of the Consumer Code.

14 – RIGHT OF WITHDRAWAL

The current legislation on withdrawal is represented by Articles 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21/2014.

Our goal is that you are satisfied with the purchase made on our site. If this is not the case, you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen days (14), from the day of receipt of the products purchased on www.chocolate7.com, giving notice to the Seller, provided that the product is resalable and closed in the original packaging.

The Seller, in case of exercising your right of withdrawal, has the right not to accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.

The good can be manipulated for the sole purpose of establishing its nature and characteristics. If the product is used outside of these purposes, you are responsible for the decrease in value of the goods that can be withheld during repayment of the amount paid.

To exercise the right of withdrawal it is sufficient that you inform us of your intention to withdraw by means of a written declaration (a letter sent by mail, or e-mail to ordini@chocolate7.com.) Before the end of the right of withdrawal.

In the request, please inform us of this information:

– Name and surname or company name;

– Order reference, date and number;

– Indication of the products to be returned and the quantity;

– Bank details (IBAN and current account holder) (account holder and C / C number, ABI, CAB, CIN) in case of payment of the order by bank transfer in advance, for the restitution of the amount paid for the purchase of the products. If the payment was made via PayPal the refund will be made directly to your account / card.

The shipping costs for the original delivery of the purchased products will not be reimbursed.

In addition to the conditions specified in the previous points, the right of withdrawal is subject to the following conditions:

The waybill must be correctly completed

The right of withdrawal only applies to intact goods at the time of return;

The products must not have been used modified or damaged;

The products must be returned in a single shipment to the Seller;

The products must be returned in their original packaging;

The Seller must receive the returned products within fourteen (14) days from the date of delivery of the order.

The consumer is only responsible for the decrease in the value of the goods resulting from the handling of goods other than that necessary to establish the nature, characteristics and functioning of the goods

15 – REFUND TIMES AND METHODS

After returning the products, the Seller will make the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 14. In the event that the checks are successfully concluded, the Seller will send you, by e-mail, the relative confirmation of the acceptance of returned products.

In the event that the withdrawal is exercised in accordance with the above conditions, the Seller will refund the customer the full amount collected for the purchase of the products, but not the shipping costs, within fourteen (14) days from the date in to which the Seller has become aware of the exercise of your right of withdrawal.

If the terms and conditions for exercising the right of withdrawal are not respected, you will not be entitled to reimbursement of the sums already paid to the Seller.

With the withdrawal you will be reimbursed all the payments you have made in our favor, within 14 days from the date on which you informed us of your intention to withdraw.

Article. 56 C.d.C. it also provides for reimbursement of the original shipping costs.

The refund will be made with the same payment method used for the initial purchase. In any case, you will not incur any fees for crediting this refund.

The refund is suspended until receipt of the goods or until the demonstration of having sent back the items, if earlier.

16 – RETURNS AND REFUNDS

You can return any product purchased on our website within 14 days from the delivery date, as follows:

Make sure the products are in the same condition in which you received them

Prepare the package in the box you received (or in a box of equal strength and size) covering the information of the first shipment.

Contact Customer Service at +39 3281925153 within 14 days from the delivery date to arrange shipping methods.

You will receive a refund which will include the cost of the returned products. This reimbursement does not include the shipping costs incurred by the consumer for the return of the goods, in accordance with the rules established by the Consumer Code.

You will receive a confirmation e-mail when we accept your return, within 3 days from the date of delivery to our warehouses.

We remind you that we can only refund products that have been returned correctly. If your return does not meet the conditions listed above we will not be able to refund.

You can check the status of your return with the shipping number by writing to the e-mail address info@chocolate7.com

When our warehouse has received your return and verified that all the conditions have been met, it will send you an e-mail confirming the acceptance of the return.

The repayment time depends on the payment methods used for the order:

Purchase by Credit Card:

the currency depends on the institution that issued the credit card, normally by two bank statements.

We remind you that the crediting date will still be the same as the debit, so you will not suffer any loss in terms of bank interest.

Purchase by bank transfer:

the reimbursement takes place on the Current Account which you will indicate to us at the time of return, so the time will depend on the correctness of the data you provide us, in any case within 14 working days.

17 – PAYMENT METHODS

To pay the price of the products and the relative shipping costs you can follow one of the methods indicated in the order form.

When purchasing, you can choose between 3 payment methods.

CREDIT CARDS

Chocolate7 accepts payment for products ordered by major credit cards (Mastercard, Visa, American Express circuits).

Credit card details are managed directly by Stripe or by other banks, specialized in the management of online payments

The information is encrypted using the latest generation of encryption systems that prevent its use by third parties and is sent directly to the bank.

Chocolate7 reserves the right to make a request to the bank issuing the card to verify the authenticity of the ownership of the card.

PAYPAL

By choosing PayPal as a payment method, you will access the PayPal login page to access your account and proceed with payment.

If you do not yet have a PayPal account you can activate it during the payment process.

If you decide to purchase with Paypal at the end of the order, you will be directed to the Paypal login page.

In this case the debit to the Paypal account takes place simultaneously with the conclusion of the transaction.

Confirmation of payment with Paypal may not be instantaneous but may require a certain amount of time, even a few hours. Payment is considered accepted only when you receive the relevant e-mail from Paypal relating to the transaction just made.

In some cases, Paypal can request a payment review that can last up to 24 hours. In this case Choc7 di Benedetto Giovanni will not proceed with the shipment until Paypal will definitively confirm the payment. The review process will be communicated to you via e-mail by Paypal.

In case of cancellation of the order, both from you and from Choc7 di Benedetto Giovanni, the amount will be refunded to your Paypal account.

BANK TRANSFER IN ADVANCE

You can also pay with a simple bank transfer. In this case, the shipment of the ordered goods will take place only after the amount due has been credited to Benedetto Giovanni’s Choc7 bank account, which must take place within 5 working days from the date of acceptance of the order. After this deadline the order will be automatically canceled.

The reason to be reported in the Bank Transfer must indicate the date and the order number, present in the subject of the confirmation e-mail.

The online transactions on Chocolate7.com are secure, as they are performed with encrypted protocol, using a 128 bit SSL digital certificate, to ensure maximum protection.

You can choose to enter billing information other than delivery data, on the DESTINATION page of the Shopping Bag.

Click on the link: “Click here to choose different billing data” to enter name, VAT number and billing address.

The price for the purchase of the products and the shipping costs, as indicated in the order form, will be debited to your current account at the time of shipment of the purchased products.

VAT is already included in the price you see in the catalog, on all the pages of the site and in the Shopping Cart.

18 – PAYMENT PROBLEMS

In case of problems with payment by credit card or Paypal, even after sending the order confirmation, we will not be obliged to send the order. In fact, it may happen that the card issuer or Paypal requires a payment verification. In this case we will not be able to proceed with the shipment until the final payment confirmation.

19 – SECURITY IN PAYMENTS

Online transactions by credit card or Paypal are made on the respective sites, through Secure Servers that adopt the SSL (Secure Socket Layer) protection system. This protocol allows you to communicate in a way designed to avoid the interception, modification or falsification of information.

Choc7 di Benedetto Giovanni never gets to know your credit card details or home banking access codes or your Paypal account.

20 – SHIPPING AND DELIVERY OF PRODUCTS

We undertake to process all orders received and paid by 12:00 at the latest on the following working day.

The shipping time changes depending on the payment method chosen.

The quickest ways are as follows:

Paypal (also with credit card or debit card)

In case of payment by Advance Bank Transfer the shipment will take place when we will receive confirmation of the credit in the bank (usually 1 or 2 working days).

In case of payment with Paypal it may happen that a payment revision is requested which can last up to 24 hours. In this case the shipment of the order will take place at the time of confirmation of payment by Paypal. You will still receive a confirmation e-mail.

We will notify you by e-mail of the delivery of your package to the courier with the indication of the link to follow the shipment directly on the courier’s website.

21 – DELIVERY METHODS AND TIMES

For Choc7 di Benedetto Giovanni it is very important that you are satisfied with both our products and our service. For this we try to be as fast and reliable as possible in the evasion and delivery of your order.

Choc7 di Benedetto Giovanni delivers the UPS courier to the address you communicated to us in the order definition phase, with the exception of exceptions.

The modification of the delivery address will be possible up to the moment of the preparation of the order that will be notified to you via eMail. Subsequently we will not be able to change the shipping address until there is the first delivery attempt.

Choc7 by Benedetto Giovanni in the cart offers you two delivery methods:

– At your address;

– At a UPS Access Point collection point of your choice.

In both cases, for delivery to the address you have communicated to us in the order definition phase we will use the courier chosen by us. Upon delivery of the package to the courier, we will notify you of the tracking number required to track the shipment.

The delivery of the articles is always meant on the roadside.

Delivery times vary

– from 1 to 7 working days for deliveries in the Italian territory,

– from 1 to 14 days for deliveries within the European Union; they may be subject to variations due to force majeure or due to traffic conditions and road conditions in general or by the Authority. Standard delivery will take place at the following times: from 9:00 am to 1:00 pm and from 2:00 pm to 6:00 pm, every day, except holidays, from Monday to Friday.

DELIVERY TO YOUR ADDRESS

The delivery of the articles is always meant on the roadside. Standard delivery will take place at the following times: from 9:00 am to 1:00 pm and from 2:00 pm to 6:00 pm, every day, except holidays, from Monday to Friday.

The recipient’s signature is required to accept the package. It is therefore essential that the delivery address you provide us is always manned by someone who can accept the package on your behalf.

If there is no one in the delivery times, think about changing the delivery address, entering your workplace or the home of a relative or friend. Alternatively, evaluate the delivery at the UPS Access Points that offer longer pick-up times and days than a standard delivery, leaving you more freedom to collect.

If the courier fails to deliver your package, he will return it the next working day for a total of 3 attempts. You will still be left with a notice of attempted delivery (also called UPS InfoNotice®) on which the options for redelivery will be indicated.

In some areas of Italy, if the first delivery attempt fails, the courier will automatically bring the package to a pick-up point (UPS Access Point) near the delivery address. However, the courier will leave a notice board (UPS InfoNotice®) with the details of the collection point.

After the third delivery attempt or after 10 days of storage at the UPS Access Point, the package will automatically return to our warehouse.

DELIVERY AT A POINT OF WITHDRAWAL UPS ACCESS POINT

UPS Access Points are convenient places, such as grocery stores, bars or other local businesses, where you can easily deposit or collect your packages. These places often offer extended opening hours even on weekends and evening hours to make your life easier.

If you are not sure if you can be at home to receive your order or if you want more flexibility in the collection times, check this delivery option available in the checkout before purchasing.

To locate the UPS Access Point closest to your address, just enter an item in the cart and log in. By selecting the “Go to the nearest UPS delivery point” option, you will be asked for your address and then you will be offered the nearest Access Points.

This delivery method is only possible for packages weighing less than 20 kg, which are not bulky. During the purchase, the checkout will enable delivery to the UPS Access Point if these requirements are met.

Select the one that interests you and proceed with the purchase. In the next step you will be asked for your data necessary for the issue of the receipt or invoice, documents also valid for the warranty on the items.

Pay attention to the order header data because they will indicate the person who will collect the package when it arrives at the UPS Access Point.

Once the package has been delivered to the UPS Access Point you will receive an eMail from UPS that will inform you of the possibility of picking up the package even on the same day.

If the withdrawal cannot be made by the order holder but by a different person, it is necessary that this be presented with a proxy, a copy of the official identity document of the real holder of the order (identity card, driving license or passport) and the tracking number of the shipment.

You have up to 10 calendar days to claim the package, after that date the package will automatically return to our warehouse.

Before collecting the package, check the opening days and times of the premises. Then go to the UPS Access Point with an official identity document (identity card, driving license or passport) that shows exactly the name and address of the order holder (your data) and the tracking number of the shipment that you received via eMail.

COMMON TO ALL DELIVERY METHODS

The order travels with customized Chocolate7 boxes suitably closed with a personalized ribbon. In no case are other closing materials used.

Once you have received the package from the courier you are required to check:

– That the number of packages delivered corresponds to what is indicated on the bill or in the transport document DDT;

– That the packaging is intact, not damaged, neither wet nor otherwise altered;

– That closing materials other than the customized Chocolate7 tape have not been used.

It is not possible to check the contents of the package until the shipment is accepted. The courier, in fact, is only responsible for the outward appearance of the package and the number of packages, not its contents.

Any external damage or mismatch in the number of packages must be immediately reported to the courier who makes the delivery, with the words “collection with reserve for damaged package” or “collection with reserve for open package” or “collection with reserve for missing packages “On the courier delivery slip.

Once the courier’s document has been signed, you will no longer be able to make any objection to the external characteristics of what was delivered.

Even if the packaging is intact, we ask you to immediately check the contents of the package to verify the correspondence between what was ordered and what was delivered. Any damage, deficiencies or hidden anomalies must be reported within a maximum period of 8 days by sending an e-mail to ordini@chocolate7.com.

22 – NON-DELIVERY OR DELAY

In the event that the Product or products purchased are not delivered or are delivered late with respect to the delivery terms from 1 to 7 working days, you can, pursuant to art. 61 of the Consumer Code, invite Choc7 di Benedetto Giovanni to make the delivery within an additional period appropriate to the circumstances (“Supplementary Term pursuant to art. 61, III paragraph, Consumer Code”). If this additional term expires without the articles having been delivered to you, you are entitled to terminate the contract (“Termination of the Contract pursuant to art. 61, III paragraph, Consumer Code”), without prejudice to the right to compensation for damages.

You are not burdened by the burden of granting Choc7 di Benedetto Giovanni the Supplementary Term pursuant to art. 61, paragraph III, Consumer Code (“Cases excluded”) if:

Choc7 di Benedetto Giovanni has expressly communicated the refusal to deliver the articles;

Compliance with the indicated delivery term must be considered essential, taking into account all the circumstances that accompanied the conclusion of the contract;

You have informed Choc7 of Benedetto Giovanni, before the conclusion of the contract, that the delivery by a certain date is essential

In the Excluded Cases, if you do not receive the items within the indicated delivery term, you are entitled to immediately terminate the contract, except for the right to compensation for damages (“Termination of the Contract in Excluded Cases”).

The indication of the Additional Term pursuant to art. 61, paragraph III, Consumer Code or Resolution in Excluded Cases you will have to send it to Choc7 di Benedetto Giovanni by sending a request to the addresses in art. 20.

In the event of termination of the contract pursuant to art. 61, paragraph III, Consumer Code or Resolution in Excluded Cases, Choc7 di Benedetto Giovanni will reimburse you the total amount due promptly. The reimbursement will take place in the manner prescribed by the order confirmation.

In the event that you do not proceed with setting the Supplementary Term pursuant to art. 61, paragraph III, Consumer Code, or by resorting to the conditions, to the Resolution of the Contract pursuant to art. 61, paragraph III, Consumer Code or to the Termination of the Contract in Excluded Cases, Choc7 di Benedetto Giovanni, without prejudice to the possibility of availing at any time of such remedies and / or the ordinary means of protection made available to the law and, in in particular, from Chapter XIV of Title II of Book IV of the Civil Code, it undertakes in any case, to:

give you timely notification by e-mail of the delay in delivery, indicating at the same time the new delivery term, if available;

in case of delivery with a delay between 1 and 3 working days with respect to the new delivery time, reimburse the shipping costs if provided for in the order and already paid, within 10 working days from the expiry of the new delivery term;

in the case of delivery with a delay of between 4 and 10 working days with respect to the new delivery time, allow you to refuse delivery and terminate the contract, with consequent repayment of the total amount due, if already paid, within 10 working days from the request for termination of the contract or, alternatively, if you do not want to terminate the contract, reimburse on request the delivery costs, if already paid, within 10 working days from the request;

in the event of late delivery of more than 10 working days with respect to the new delivery date or, in any case, 20 days prior to the original delivery date, to offer you on request, the supply of a different Product of equivalent or higher value, subject to payment, in the latter case, of the difference and subject to your express consent.

23 – TRANSPORT COSTS

The transport cost is free for all orders over 49 Euros with delivery in Italy, the European Union and the United Kingdom of Great Britain and Northern Ireland. For orders of less than 49 Euros, the transport cost is €4.90.

while for orders of a lower amount the shipping cost is

– € 8.85 for the Italian territory

– € 14.85 for the territory of the European Union

For non-European countries the cost of transport is your responsibility and is calculated automatically according to the weight and volume of the items purchased.

To know exactly the cost of transport, simply view the cart after entering the desired product. In any case, the shipping cost is due if the customer is a retailer or if he has received an offer where the shipping cost is explicitly stated.

24 – USER REGISTRATION

To register, just enter your name, e-mail address and password.

Registered users can enjoy the following benefits:

25 – USE OF DISCOUNT CODES

The discount code is an alphanumeric code which, inserted in the appropriate field in the cart, allows a price reduction on all or on some items.

Each discount code always has an expiration date and can have a limited number of uses.

In no case is it possible to apply a promotional code to an order already submitted.

If you confirm an order without entering the discount code correctly, or if you receive a promotion code from our e-mail correspondence or from our Newsletter or from our social channels, after you have placed an order with us, we will not be able to refund the discount.

If you receive a discount code from our e-mail correspondence, from our Newsletter or from our social channels, in order to benefit from the discount it must be used before this expires. We cannot accept discount codes after they have expired.

The moment in which a discount code expires, unless otherwise indicated, is always at 11.59 pm on the expiry day.

It is possible to enter a discount code per order. No more vouchers can be applied for the same order.

Benedetto Giovanni’s sales contract between Choc7 and Customer is concluded in Italy and governed by Italian law.

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206, and subsequent amendments and additions, on the consumer code, with specific reference to the legislation on distance contracts, and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

For the solution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial competence is that of the reference forum of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Turin.

30 – MODIFICATION AND UPDATING OF CONDITIONS
